General Terms and Conditions
1. Scope of application
These terms and conditions (“Terms of Service”) apply to all orders for items which you, acting in your capacity as a buyer place with us, YTS Pump Engineering B.V. on-line using the website which we operate from the URL: “https://airdiaphragmpump.co.uk”.

The representation of the products on the online shop do not represent a legally binding offer, but instead represent an unbinding online catalog. You can initially place our products in the shopping cart without commitment and correct your input at any time before you submit your binding order by using the correction tools, which are provided and explained during the ordering process. By clicking on the order button, you are submitting a binding order of the merchandise included in the shopping cart. A confirmation of receipt of your order is sent by email directly after your order is submitted.
PayPal
During the ordering process, you will be forwarded to the website of the online provider PayPal. You can enter your payment information there and confirm your payment instruction to PayPal. Once the order is placed in the shop, we will request PayPal to begin the payment transaction and will thereby accept your offer.
Bank Transfer
Payment via bank transfer. Please be sure to include your order invoice number in the payment reference field when you enter the information for your bank transfer. Please transfer the balance to the following account:

3. Contract language and record of contract text
The languages available for concluding the contract is English.
We do not save the text of the contract.
4. Delivery conditions
For all products in our shop delivery is free of charge.
Delivery is to be made only to addresses in the United Kingdom.
We only deliver our merchandise through shipping. Unfortunately, it is not possible to pick up your merchandise yourself.
5. Specifications
YTS Pump Engineering B.V. makes every effort to display the colors, sizes and specifications of products available on the Website as accurately as possible. The colors you see will however depend on the resolution of your monitor. We cannot guarantee that your monitor’s display of any color will reflect accurately the color of the item delivered. We may from time to time vary the sizes and specifications of items displayed on our Website without prior notice. We cannot guarantee that a particular color, size or specification of an item will be available. A member of our Customer Services team will contact you if the item you have ordered is no longer available.
6. Prices
Items are invoiced in GBP sterling at the price prevailing at the time you place your order. Please note that we can only accept payment in GBP sterling.
Prices displayed on the Website exclude Value Added Tax (VAT). Products are sold by Dutch legal entity. We will not charge VAT if products are sold to the UK business with a valid EU VAT number (United Kingdom EU VAT number format – GB 123456789 – 9 characters). The buyer is responsible for calculating and paying VAT in the UK, where his business is registered.
If buyer doesn’t have a valid EU VAT number, the Dutch 21% VAT will be added to the prices at the checkout and clearly displayed before purchase.
Whilst YTS Pump Engineering B.V. endeavours to ensure that all prices on the Website are accurate, errors may sometimes occur. If we discover an error in the price of items you have ordered we will contact you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we may treat your order in respect of the incorrectly priced item as cancelled.
7. Availability and Substitution of Items
The acceptance of orders by YTS Pump Engineering B.V. is always subject to availability of the items ordered. If for any reason the items you ordered are no longer available we will at our discretion either offer you another item of equivalent quality and price (where this is possible) or, alternatively, cancel the item from your order and where payment has already been deducted from your account give you a full refund in respect of that item.
8. Payment
Generally, the following payment methods are available at our shop:
PayPal
During the ordering process, you will be forwarded to the website of the online provider PayPal. In order to be able to remit payment for the amount due using PayPal, you have to be registered there or you can first complete the registration process, prove your identity with your login details, and then confirm payment to us. Once the order is placed in the shop, we will request PayPal to begin the payment transaction.
The payment transaction is automatically carried out by PayPal directly afterwards. You will receive more instructions during the ordering process.

9. Reservation of proprietary rights
The goods shall remain our property until full payment is received.
10. Transport damage
If the merchandise is delivered with obvious transport damage, you should lodge a complaint with the delivery agent about these types of mistakes immediately if possible, and please contact us immediately. The failure to lodge a complaint or contact us does not have any consequences on your legal claims and enforcement, in particular on your warranty rights. However, you will assist us in being able to exercise our own rights against the freight forwarder and transport insurance company.
11. Cancellation policy
Customers have a period of 14 days from the day they receive the goods to notify YTS Pump Engineering B.V. that they wish to cancel or return an item. Once YTS Pump Engineering B.V. have been notified, the customers have a further 14 days to send the goods back at their own cost.
YTS Pump Engineering B.V. will refund the customer within 14 days of it receiving the goods. All items must be returned as sold, in their original packaging. All items not be used or installed otherwise a refund will be refused.
From the repayment amount will be deducted delivery cost incurred by YTS for the product delivery to the buyer address.

12. Faulty or Damaged Items
If the items you ordered are damaged or faulty upon receipt, provided you inform us within 14 days of receiving the items (supplying them with the reference details shown on the delivery documentation together with details of the damage or fault) we will send replacements or offer you a refund. We ask that you return the damaged or faulty items to us and will reimburse the reasonable costs you incur in doing so. We ask that you send us copies of the supporting receipts. Refunds will be credited to the payment method used to make the original purchase.
If returning an item due to a fault, we will determine if the fault was caused by a manufacturing defect or incorrect installation. If the fault is caused by any other means apart from a manufacturing issue, a refund will not be offered. If the fault was a manufacturing fault, a full refund or replacement will be provided. A full pump report will be provided upon request
13. Warranty Claims
If you have a warranty claim, please contact us to process your claim. Please have your original order number so we can determine the correct procedure.
14. Non-Delivery
If the items you ordered are not delivered by the delivery date indicated please contact us immediately.
15. Privacy and Communications
When you place orders, we collect certain personal and transactional information (e.g. name, address, email address). For details on how we use this information, please read our Privacy Policy.
To fulfil our obligations to you under these Terms and Conditions we communicate with you by e-mail and by posting notices on the Website. You agree to receive communications from us electronically in this way and that electronic communications will satisfy any legal requirement for communications be in writing.
16. Losses
We will be responsible for any losses you suffer as a direct result of us breaching these Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract between us for the sale of items was formed. We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our appointed sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.
Our liability to you under these Terms and Conditions will not exceed the total price charged for the items purchased. Nothing in these Terms and Conditions excludes or limits our liability to you for personal injury or death caused by our negligence.
Under the Distance Selling Regulations, YTS Pump Engineering B.V. has 30 days (from the day after the day the customer places their order) to deliver the items, unless it has agreed a different period with the customer. If YTS Pump Engineering B.V. cannot (for any reason) deliver within this 30 day period it will need to notify the customer and agree an extended delivery period to avoid being in breach of the Regulations. If YTS Pump Engineering B.V. fails to deliver the items it will be obliged to refund the customer.
17. Force Majeure
We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
18. Changes to this Website and Terms and Conditions
We reserve the right at any time to make changes to the Website, these Terms and Conditions, the Website Conditions of Use , Privacy Policy and such other policies as we may notify you of from time to time. You will be subject to the policies and terms and conditions in force at the time you order items using the Website or by telephoning our Customer Services team. Changes which we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, they will be deemed severable and will not affect the validity or enforceability of the remaining terms and conditions.
19. Governing law and jurisdiction
By visiting YTS Pump Engineering B.V. you agree that the laws of the Netherlands, without regard to principles of conflict of laws, will govern these Terms of Service and any dispute of any sort that might arise between you and YTS Pump Engineering B.V. or its associates.
